1. About these terms
These terms and conditions ("Terms") govern your use of the website operated by Giftery Ltd ("Giftery", "we", "us" or "our"), a company registered in England and Wales, and your purchase of digital gift cards through our platform. By browsing the site, creating an account or placing an order you agree to be bound by these Terms. Please read them carefully and save a copy for your records.
2. Who we are
Giftery Ltd operates a marketplace that sells digital gift cards issued by third-party UK retailers and brands. You can contact us at support@giftery.co.uk or via the contact page.
3. Eligibility
To place an order you must be at least 18 years old, resident in the United Kingdom, and capable of entering a legally binding contract. By placing an order you confirm that you meet these requirements and that the payment details you provide are your own or that you have authority to use them.
4. Accounts
Some features — including checkout and gift code delivery — require a Giftery account. You are responsible for keeping your login credentials confidential and for all activity carried out through your account. You must verify your email address before we can deliver gift codes to you. Please tell us immediately if you suspect any unauthorised use of your account.
5. Gift cards
5.1 Nature of the product
Gift cards sold on Giftery are digital codes that may be redeemed with the named third-party retailer. Each gift card is subject to the issuing retailer's own terms, including any restrictions on use, expiry dates and excluded products. We are not the issuer of the gift cards and our liability for the underlying retailer's performance is limited as set out in clause 11.
5.2 Denominations and pricing
Prices are shown in pounds sterling (GBP) or US dollars (USD), selectable at checkout, and include any applicable taxes. USD prices are converted from GBP using a live exchange rate locked at the time you place your order. We reserve the right to correct pricing errors before your order is accepted.
5.3 Delivery
Gift codes are delivered by email to the verified address on your Giftery account once payment has cleared and your email has been verified. Delivery is normally instant but may take up to 24 hours during periods of high demand or where additional fraud checks are required. It is your responsibility to provide an accurate email address and to check spam or junk folders.
5.4 Scheduled delivery
Where you choose a future send date for a gift, the code will be issued on or shortly after that date provided your account remains in good standing.
6. Orders and payment
Your order is an offer to buy. A binding contract is formed only when we send you an order confirmation email containing the gift code(s). We may decline or cancel an order, including where we suspect fraud, where stock is unavailable, where pricing is incorrect, or where required information has not been provided.
Payment is taken at the point of order using the methods displayed at checkout. Your bank or card issuer may apply additional checks before authorising the payment.
7. Right to cancel and refunds
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the supply of digital content (including gift codes) is exempt from the standard 14-day cancellation right once the code has been delivered to you. By completing your purchase you expressly consent to immediate delivery and acknowledge that you lose the right to cancel as soon as the code is issued.
If a gift code is faulty, was not delivered, or was delivered in error, please contact us within 30 days and we will investigate. Where we are at fault we will reissue the code or provide a refund using your original payment method.
8. Use of the site
- You may use the site only for lawful purposes and in accordance with these Terms.
- You must not resell, redistribute or commercially exploit gift codes purchased through Giftery without our written consent.
- You must not attempt to gain unauthorised access to the site, interfere with its operation, or use automated means to scrape or extract data.
- You must not impersonate another person or provide false information when placing an order.
We may suspend or terminate accounts that breach these Terms or that we reasonably believe are being used fraudulently.
9. Intellectual property
The Giftery name, logo, site design and all content (other than third-party brand assets) are owned by or licensed to Giftery Ltd. All third-party brand names, logos and trade marks displayed on the site are the property of their respective owners and are used to identify the gift cards available for sale. Nothing on the site grants you any licence or right to use any trade mark without the owner's prior written consent.
10. Privacy and data
We process personal data in accordance with the UK GDPR and the Data Protection Act 2018. Details of the data we collect, how we use it and your rights are set out in our Privacy Policy. By using the site you acknowledge that you have read the Privacy Policy.
11. Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded by English law.
Subject to the above, our total liability to you in connection with any order is limited to the price you paid for the affected gift card. We are not liable for any indirect, consequential or special losses, loss of profit, loss of opportunity, or loss arising from your use of, or inability to use, a gift card with the relevant retailer.
12. Events outside our control
We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including network outages, payment processor failures, cyber-attacks or actions of the issuing retailer.
13. Changes to these terms
We may update these Terms from time to time. The version that applies to your order is the version published on the site at the time you place the order. Material changes will be notified by email or through a prominent notice on the site.
14. Governing law and jurisdiction
These Terms and any dispute arising from them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your local courts.
